Booking agreement

1. The parties and how this agreement takes effect

This agreement is between The Drifters ("the Band") and the person or organization submitting this booking request ("the Client").

Submitting a request is an offer, not a booking. This agreement takes effect — and the date is reserved — when the Band confirms the booking and the deposit is received. The Band will send confirmation electronically.

The Client accepts these terms electronically by checking the acceptance box on the booking form. No handwritten or physical signature is required, and both parties agree that electronic acceptance is binding to the same extent as a signature. The Band records the date, time, and version of the terms accepted, and will provide a copy on request.

If the Band does not confirm the request, no agreement is formed and nothing is owed by either party.

2. Fees, deposit, and payment

The total fee is the amount stated in the Band's written confirmation, including any travel charges.

A deposit of 25% of the total is due within 7 days of confirmation. The date is not reserved until the deposit is received, and the Band may accept other bookings for that date until it is.

The remaining balance is due on the day of the event, before the Band's equipment is removed. Accepted methods: cash, Venmo, or check.

Prices quoted through this website apply to the performance window selected by the Client. Changing that window changes the fee.

3. Cancellation by the Client

More than 30 days before the event: the deposit is refunded, less any costs the Band has already incurred and cannot recover.

8 to 30 days before the event: the Band retains the deposit.

7 days or fewer before the event: the full agreed fee is due, whether or not the event takes place.

A postponement is treated as a cancellation unless both parties agree to a new date in writing. If a new date is agreed, the deposit transfers to that date.

4. Cancellation by the Band

If the Band cancels for any reason other than those described in Sections 5 and 6, the Band refunds all amounts paid, including the deposit.

The Band will make reasonable efforts to help the Client find a replacement performer, but does not guarantee a replacement.

5. Outdoor events, weather, and on-site conditions

Outdoor events require a covered performance area or a workable indoor alternative, confirmed at the time of booking. The Band's equipment cannot be exposed to rain or standing water.

Once the Band has traveled to the venue and begun setup, the full agreed fee is due, regardless of whether the performance takes place or is cut short. This includes cancellation or interruption due to weather, power failure, venue decisions, low attendance, or any other cause outside the Band's control.

The Band may suspend or end a performance, or decline to begin, if conditions present a risk to persons or equipment — including severe weather, unsafe electrical supply, unsafe footing or staging, or threatening behavior by attendees. The full agreed fee remains due once the Band has traveled and set up.

If severe weather is forecast and both parties agree, in writing and before the Band departs for the venue, to cancel or reschedule, the event is treated as a mutual cancellation under Section 6.

6. Circumstances beyond either party's control

Neither party is liable for failure to perform due to causes beyond its reasonable control occurring before the Band departs for the venue, including serious illness or injury, death of a Band member or immediate family member, accident, venue closure, government restriction, or civil emergency.

In that case the deposit is refunded in full, or applied to a rescheduled date at the Client's option.

Once the Band has departed for and set up at the venue, Section 5 applies instead.

7. What the Client provides

Two dedicated 20-amp electrical circuits at the performance area, and a performance space of approximately 16 feet wide by 12 feet deep.

Access to the performance area at least 90 minutes before the scheduled start for load-in and setup, and parking near the load-in point.

A safe performance area with level, stable footing and protection from rain and direct weather.

If these are not available on arrival, the Band will work with the Client where reasonably possible; if the conditions make performance unsafe or impossible, Section 5 applies.

8. Performance

Unless otherwise agreed in writing, a standard engagement is two 60-minute sets with a 20-minute intermission, within the booked performance window.

The Band performs family-friendly material by default. Specific content requirements must be raised at the time of booking.

Song requests are welcome and accommodated where practical, but are not guaranteed.

9. Recordings, photography, and promotion

The Client and attendees may photograph and record the performance for personal use and for promotion of the Client's event.

The Band may use photographs, audio, and video from the engagement to promote the Band, unless the Client objects in writing before the event.

10. Travel

The first 30 miles from Haubstadt, Indiana are included in the quoted fee. Additional distance is charged at the Band's current per-mile rate, calculated round trip and shown in the quote before the request is submitted.

Engagements beyond the Band's standard travel range require overnight accommodation for five people and are quoted individually rather than through this website.

11. Changes to a confirmed booking

Any change to the date, time, location, performance window, or fee must be agreed by both parties in writing. Email or text message satisfies this requirement.

Changes are subject to the Band's availability. A change the Band cannot accommodate is treated as a cancellation under Section 3.

12. Liability

The Band maintains its own equipment insurance. The Client is responsible for the venue, the conduct of attendees, and the safety of the performance area.

Neither party is liable to the other for indirect or consequential losses. The Band's total liability under this agreement is limited to the amounts the Client has paid to the Band.

Nothing in this agreement limits liability for injury or damage caused by a party's own negligence, to the extent that limitation is not permitted by law.

13. General

This agreement, together with the Band's written confirmation, is the entire agreement between the parties and replaces any prior discussions.

This agreement is governed by the laws of the State of Indiana.

If any provision is found unenforceable, the remaining provisions continue in effect.

The Client confirms they are at least 18 years old and authorized to enter this agreement on behalf of the event.
